Manufacturer warranties, if any, apply only as provided by the manufacturer.
TO THE FULLEST EXTENT PERMITTED BY LAW, CasterHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, OR DOWNTIME.
CasterHQ’s TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Buyer acknowledges it is not relying on any oral statements, representations, or advice outside of these Terms or a written agreement executed by CasterHQ.
Buyer agrees to indemnify and hold harmless HD Industrial Supply, LLC and its affiliates from any claims, damages, losses, liabilities, or expenses arising from product misuse, improper installation, or violation of these Terms.
Any dispute arising out of or relating to this site or any transaction shall be resolved through binding individual arbitration conducted in Texas.
YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
These Terms are governed by the laws of the State of Texas. Any arbitration or legal proceeding shall occur exclusively in Texas.
Any claim must be brought within one (1) year after it arises, or it is permanently barred.
CasterHQ may assign these Terms at any time. If any provision is held unenforceable, the remaining provisions remain in effect.
